DA UNEF À MONUSCO E ALÉM: AS OPERAÇÕES DE PAZ DA ONU E O USO DA FORÇA AUTORIZADO PELO CONSELHO DE SEGURANÇA

Visto que as operações de paz não estão previstas na Carta da ONU, este artigo objetiva determinar a posição destas ações em meio às competências do Conselho de Segurança, com vistas a alcançar clareza conceitual quanto à relação das operações de paz com o uso da força autorizado pelo órgão. Assim, a primeira seção aborda as missões entre as décadas de 1940 e 1990, quando se buscou diferenciá-las da ação coerciva sob o Capítulo VII. A seção seguinte, após menção às dificultosas operações na Bósnia, na Somália e em Ruanda, analisa (i) a diferenciação entre manutenção e imposição da paz e (ii) o conceito de operações de paz robustas encarregadas de proteger civis, concluindo que, (iii) ao final da década de 1990, as missões da ONU se aproximaram do uso da força.
