Sobre a ilegalidade das leis de anistias para crimes graves

Resumo

A proposta do presente artigo é discutir a legalidade de leis de anistia face à obrigação dos Estados de punir ou extraditar responsáveis por casos de graves crimes internacionais. Em outras palavras, o objetivo do mesmo é responder à questão: “Qual a legalidade das leis de anistia perante o direito internacional em casos de crimes de jus cogens?” Para tanto, o artigo avalia primeiramente o reconhecimento do principio aut dedere aut judicare (perseguir ou extraditar) como obrigação internacional, levando em consideração o direito positivado em tratados internacionais, o direito consuetudinário e a doutrina. Posteriormente, ele discute a legalidade de leis domésticas de anistia à luz de tal princípio por meio da análise de dispositivos legais internacionais supostamente permissivos e de casos jurisprudenciais.
